General Terms and Conditions
§ 1 Purview
Exclusively the subsequent General Terms and Conditions in the legal version at the time of the order apply for the business relations between Cockpit4u Aviation Service GmbH, chief executives Stefan Heuß & Dennis Pilz (in the following designated Cockpit4u) and the visitor/customer of the Online Shop (in the following designated customer). COCKPIT4U only accepts deviating conditions if agreed on those conditions explicitly in written form.
§ 2 Conclusion of contract
By sending the order the customer makes an offer for a sales contract for the ordered articles. The customer receives a confirmation via e-mail by COCKPIT4U. By means of this confirmation COCKPIT4U accepts the offer of the customer to the confirmed extent and commits to the delivery in accordance with the General Terms and Conditions. By placing an order the customer affirms to be of legal age and capable to contract.
§ 3 Right of rescission and return
The customer can revoke their offer without naming a reason within two weeks in written form or they can return the received articles within two weeks by sending them back. The period starts with the customer's gaining knowledge of these instructions. The customer is required to send the articles via parcel shipment unless the nature of the article does not allow that (e.g. bulky goods). In this case the customer can execute their right of return through a request of return in text format, i.e. for instance via letter, fax or e-mail. Dispatching the revocation on time to the following address is sufficient for meeting the deadline:

In case of a return COCKPIT4U bears the costs and risk of the return if the value of the customer's order exceeds an amount of 40,- € incl. tax. In case of a carriage forward reshipment COCKPIT4U will refuse acceptance. The delivery will be sent back to the originator immediately. For carriage forward reshipment a return receipt must be requested from the above mentioned address. If the delivered articles are deficient or non-corresponding with the ordered articles COCKPIT4U bears the costs of the return in any case. Should the customer use the articles according to their purpose, COCKPIT4U has a right to charge re-compensation for lost value in particular due to traces of use, in certain cases this can imply a complete loss in value. The customer's right of inspection is unaffected by this matter.
§ 4 Payment and delivery
The purchasing price becomes due for payment through the confirmation of the customer's offer by COCKPIT4U. The payment occurs only via prepayment through bank transfer. The customer receives the details of the bank account as a part of the confirmation mail. After the payment receipt COCKPIT4U sends the ordered articles to the customer immediately. Should an article be out of stock COCKPIT4U will inform the customer via email. The delivery of orders within Germany up to a parcel weight of 31 kg (including transport insurance) is free of charge. Delivery of the ordered articles separately does not lead to an increase in delivery charge.
§ 5 Delivery
Deliveries outside Germany are only possible after making special arrangements for the purpose of clarifying delivery details. Information about terms of delivery is noncommittal, unless there has been a binding agreement on the delivery date. Should the customer refuse the acceptance of a delivery in due form, they bear the costs for renewed shipment and possible additional costs of the mail-order firm consulted by COCKPIT4U. These costs are due via prepayment before the second delivery.
§ 6 Warranty / Materials defect liability
The rights of the customer in case of deficiency of the delivered article comply with statutory regulations under reserve of the following terms: obligation to inspect and give notice of defects. The customer must inspect the delivered articles for deficiencies and correspondence with state according to the description in the Online Shop. Apparent deficiencies or deviations are to be indicated to COCKPIT4U. The dispatch of the deficiency indication must ensue within two weeks after the receipt of the articles. Should an article reach the customer damaged, they are obliged to fill in a damage confirmation report in the presence of the parcel deliverer.
§ 7 Liability
COCKPIT4U is only liable for their own intentional or wantonly negligent violations of duty respectively those of its legal representatives and vicarious agents according to legal regulations. Moreover, COCKPIT4U only is liable for damages caused by slight negligence if compliance with the violated duty is of particular importance for the purpose of the contract and in this case only for typically forseeable damages which usually do not exceed the purchasing price. The precedent limitations of liability are not effective in case of an injury to life, body and health.
§ 8 Value-added tax
The prices of COCKPIT4U comprise the legal tax on sales of the Federal Republic of Germany. Orders from European Union third countries are basically free from tax (e.g. Switzerland), however, they are liable to a foreign addition of 19%. The prices of European Union third countries are therefore not identical with those of the European Union countries.
§ 9 Data protection
COCKPIT4U is entitled to collect, process and save personal data and use it for their own purposes within the legal limits, notably in accordance with the valid regulations of the Federal Data Protection Act and the Remote Service Statute. These are only relevant for an order placed in our Online-Shop. In particular, COCKPIT4U is entitled to use and publish this data in the course of the customer's calling on COCKPIT4U's services and, as far as it is necessary for the utilisation of these services, to forwarding it to third parties, insofar as this is necessary for preserving the entitled interests of a third party or the public interest, as to forwarding the data to a service provider in order to deliver the articles. The customer is at any time entitled to obtain information concerning the personal data saved on his/her account and to have it deleted, insofar as it is not needed for a pending business transaction.
§ 10 Place of jurisdiction
In commercial business operations the place of jurisdiction is in case of a lawsuit the headquarters of COCKPIT4U.
